German BKartA ends CO2 enquiry

The German competition authority, BKartA, has ended the so called "CO2 enquiry" against RWE. The authority had alleged that the effect that the price of CO2 permits had on electricity prices were a result of uncompetitive behaviour.  RWE had maintained that the price relationships were driven by competitive forces.  BKartA and RWE have now agreed on a settlement were RWE undertakes to auction off a defined capacity of power to industrial customers for a period of 4 years while the BKartA ends the investigation.
 
Frontier (Cologne and London) has advised RWE and presented its analysis at a public hearing - the first of its kind in Germany.
