Mobile termination rate regulation in Ukraine
Mobile termination rates are currently the subject of ongoing discussions in the Ukraine between the Antimonopoly Committee (AMC), the National Commission for Communication Regulation (NCCR) and telecommunications operators. Under the current regime, Urktelecom's rates are determined by regulation while all other operators' rates are based on bilateral negotiations. In most other EU jurisdictions, mobile termination rates are based on detailed cost studies.
George Houpis, Director of Frontier's (Europe) Telecommunications Practice, presented to the NCCR on best practice regulation in other jurisdictions and proposed a roadmap of how cost based regulation could be implemented in the Ukraine. This included drawing on international experience and expertise to ensure the best possible outcome and using multi-year glide paths. George described how introducing cost oriented termination rates can be a complex and resource intensive process and how, therefore, an interim measure based on benchmarking could be appropriate. A one day workshop with the NCCR was proposed to discuss the options for implementation in further detail.
