Competition policy

Frontier is involved in many of the principal mergers and trade practices disputes in Australia and New Zealand.

We work alongside clients and legal counsel.

We assist in preparing submissions of clients to regulators who are seeking clearance of mergers.

We give advice about the economic issues in disputes that are potentially litigious and we give expert evidence in cases before the courts.

A selection of the matters we have advised on includes:

  • ASX – SFE merger –  Retained by solicitors for ASX to prepare submissions and analysis of trading data for its application to the ACCC for clearance of its merger with SFE. The merger was cleared. (2006)
  • Westpac potential acquisitions – Retained by Westpac to assist them in a review of the implications for competition of possible acquisitions. (2006)
  • Visa New Zealand – The New Zealand Commerce Commission has issued proceedings against Visa for price-fixing in connection with setting interchange fees. Frontier has been retained by Visa. (2007)
  • ANZ price fixing allegation – The ACCC issued proceedings against the ANZ bank alleging that its refusal to provide rebates to a mortgage broker was an attempt at price fixing. Frontier has been retained to advise lawyers for the bank. (2007)
