Commission decision against GlaxoSmithKline annulled
Today, the Court of First Instance annulled the European Commission's decision that GlaxoSmithKline had infringed Article 81 of the EC Treaty by entering into an agreement with Spanish wholesalers operating a distinction between prices charged in the case of domestic resale of reimbursable drugs to pharmacies and hopsitals and higher prices charged in the case of exports to any other Member State.
Frontier (London), advised Glaxo during the administrative proceedings and upon appeal before the CFI.
