Dutch power merger investigation goes to second phase

The Dutch Competition Authority, NMa, has today published its decision on the proposed merger between Essent and Nuon. The NMa has decided that the merger raises a number of possible concerns which should be investigated further. Under Dutch competition law the merging parties will now need to apply for a licence to procede with the merger and the application would necessitate a more detailed investigation by the NMa.

In its decision the NMa has extensively referred to a number of recent studies by Frontier (London and Cologne) on various aspects of the Dutch electricity and gas market.
