Swisscom’s acquisition of Vodafone Italy cleared by AGCM

The Italian Competition Authority (AGCM), Telecommunications Regulator (AGCOM) and the Ministry of Enterprises and Made in Italy (MIMIT) have approved Fastweb’s (part of Swisscom Group) acquisition of Vodafone Italy (part of Vodafone Group), accepting the remedies proposed by the parties.

After an in-depth review of the wholesale and retail fixed markets, AGCM accepted the remedies proposed, consisting of continued access to Fastweb’s wholesale fixed services for third parties and the sharing of information with competitors in any tenders for fixed services to PAs where Fastweb or Vodafone are current providers. These commitments will last for three years and will be monitored by an independent trustee.

Frontier Economics advised Vodafone during the antitrust process, with an Italian team at Frontier supporting the engagement with the Italian Competition Authority throughout. The team was led by Carlotta Bonsignori, with Sara del Vecchio and Monica Gambarin. Frontier regularly advises clients in Italy on antitrust and telecommunications matters.
