An arbitral tribunal has rejected claims against Bulgaria by international investors in the electric power sector, brought under the Energy Charter Treaty.

As reported in Global Arbitration Review, Bulgaria’s ministry of finance noted the investor had claimed €967 million plus interest.

Frontier’s energy experts Dr Christoph Riechmann, Dan Roberts and Matt Roberts, as well as the late Wynne Jones, were appointed as expert witnesses by Arnold & Porter on behalf of Bulgaria. Frontier experts also provided testimony in two earlier cases, which were also decided in favour of Bulgaria in 2019 and 2021.

These complex disputes concerned assets across the electricity supply chain, including generation, distribution, and retail, and spanned over a number of years.  We leveraged our deep energy market and regulatory expertise to provide testimony not only on the quantum, but also on the merits of the claims.
