Romanian High Court upholds annulment of 13.5 million EUR fine against Orange Romania.

The Romanian High Court of Cassation and Justice has conclusively upheld the annulment of a fine of 13.5 million EUR applied in 2019 by the Romanian Competition Council against Orange Romania for an alleged abuse of dominant position. In 2019, the Council had concluded that Orange abused its dominant position by refusing to supply access to short numbers to an SMS aggregator company. The High Court’s definitive decision confirmed a prior annulment of the fine by Bucharest’s Court of Appeal in 2021.
